Under the Data Protection Act 1998, any organisation that processes personal information must register with the ICO.\u00a0 While failure to do so is a criminal offence, some organisations may be exempt and may not need to register or \u2018notify\u2019 the Information Commissioner\u2019s Office.<\/p>\n<h4><strong>What is \u2018personal data\u2019?<\/strong><\/h4>\n<p>Personal data is information about individual people, where they live, what they do and more. It\u2019s any and all information that identifies them, including:<\/p>\n<ul>\n<li>people\u2019s names and addresses;<\/li>\n<li>photographs;<\/li>\n<li>customer reference numbers;<\/li>\n<li>customer reviews.<\/li>\n<\/ul>\n<p>If a document, file or image identifies a person, or could be used in combination with other information to identify them, then it\u2019s personal data. This applies even if the information doesn\u2019t include a person\u2019s name.<\/p>\n<h4><strong>What does \u2018handling personal data\u2019 mean?<\/strong><\/h4>\n<p>Handling personal data means taking any action with someone\u2019s\u00a0<a href=\"https:\/\/ico.org.uk\/for-organisations\/data-protection-advice-for-small-organisations\/key-data-protection-terms-you-need-to-know\/#personaldata\" target=\"_blank\" rel=\"noopener\">personal data<\/a>. This begins when a business\u00a0starts making a record of information about someone, and continues until they no longer need the information and it\u2019s been securely destroyed. If you hold information on someone, it counts as processing even if you don\u2019t do anything else with it.<\/p>\n<p>So, in the example of a fish and chip shop, personal data might include a list of customers\u2019 names, addresses and phone numbers that they use for ordering and delivering food, or images that they record on their CCTV system.<\/p>\n<h4><strong>Which businesses are exempt?<\/strong><\/h4>\n<p>Organisations that only processes personal information for:<\/p>\n<ul>\n<li>staff administration (including payroll);<\/li>\n<li>advertising, marketing and public relations (in connection with their own business activity);<\/li>\n<li>accounts and records;<\/li>\n<\/ul>\n<p>Some not-for-profit organisations;<\/p>\n<p>Organisations that process personal data only for maintaining a public register;<\/p>\n<p>Organisations that do not process personal information on computer.<\/p>\n<h4><strong>Does this apply to my business?<\/strong><\/h4>\n<p>You might use personal data in a slightly different way to the examples described above.
